Privacy Policy

Version 1.0 · Effective 13 October 2026 · Applies to the NearoMarket (Resident), NearoMarket Partner (Vendor) and NearoMarket Delivery mobile applications and nearomarket.com

Introduction

NearoMarket ("NearoMarket", "we", "our", or "us") is a hyperlocal marketplace platform designed to connect residents of participating communities with independent vendors and delivery partners.

NearoMarket is committed to protecting user privacy and handling personal information responsibly, transparently, and in accordance with applicable laws.

This Privacy Policy describes how NearoMarket collects, uses, shares, stores, retains, and protects personal information when users access its mobile applications, website, and associated services.

1. About NearoMarket and Contact Information

NearoMarket operates as a technology-enabled platform facilitating product discovery, order placement, communication, and delivery coordination between residents, independent vendors, and delivery partners.

Independent vendors are responsible for the products they offer, while delivery partners perform delivery-related services in accordance with the applicable platform arrangements.

NearoMarket processes personal information as necessary to operate its platform, provide requested services, maintain platform security, comply with applicable legal obligations, and pursue other purposes described in this Privacy Policy where permitted by law.

For privacy-related questions, requests, or grievances, users may contact:

Privacy and grievance contact: NearoMarket Grievance Team, support@nearomarket.com. We aim to acknowledge complaints within 48 hours and to resolve them within one month, or sooner where the law requires. Operator identification, correspondence address and named grievance officer details will be provided where required by applicable law, including on request by a competent authority.

2. Personal Information We Collect

NearoMarket collects and processes personal information that is reasonably necessary to operate, maintain, secure, and improve its hyperlocal marketplace platform. The nature and extent of information collected may vary depending on the user's role, the services accessed, and their interactions with the platform.

2.1 Residents

When residents register for or use NearoMarket, we may collect and process the following information:

2.2 Vendors

When vendors register for or operate through NearoMarket, we may collect and process:

2.3 Delivery Partners

When delivery partners register for or use NearoMarket, we may collect and process:

2.4 Payment-Confirmation Photographs

As part of NearoMarket's standard delivery process, delivery partners are generally required to capture or upload a photograph or screenshot of the resident's UPI payment confirmation for each successfully completed delivery. Where a photograph cannot be obtained, the platform may permit an operational exception, subject to the delivery partner providing a mandatory reason recorded against the relevant order. Such exceptions may be reviewed by authorised NearoMarket administrators for operational monitoring, payment-related dispute resolution, and prevention of misuse.

The photograph or screenshot may contain the resident's name, UPI ID, transaction amount, transaction reference number, and other relevant information visible on the payment confirmation.

These photographs are collected for payment documentation, transaction-related recordkeeping, fraud prevention, and the investigation or resolution of payment disputes.

Access and visibility: Payment-confirmation photographs are accessible only to authorised NearoMarket administrators through restricted administrative systems. They are not made available through the Resident, Vendor Partner, or Delivery Partner applications after submission.

Payment responsibility: Residents make payments directly to vendors through UPI. NearoMarket does not receive, hold, or independently process the underlying resident-to-vendor payment. A payment-confirmation photograph is supporting evidence and does not, by itself, establish that the vendor received the funds. Vendor confirmation remains the primary basis for determining payment receipt under the platform's operating procedures.

Retention: Payment-confirmation photographs are subject to the retention and deletion practices described in Section 6. Related photographs may be deleted earlier following successful account deletion, subject to applicable lawful retention requirements.

2.5 Technical and Operational Information

When users access or interact with NearoMarket, certain technical or operational information may be collected or processed to support authentication, application functionality, notifications, security, troubleshooting, and platform administration. Depending on the services used, this may include:

Such information may also be processed by authorised technology and infrastructure providers acting in connection with NearoMarket's services.

2.6 Camera and Photograph Access

Certain application features allow users to select or capture photographs, such as vendor shop images, product photographs, payment QR codes, and delivery-related payment confirmations.

Camera or photograph access is requested when required for the relevant functionality and is subject to applicable device permissions. NearoMarket does not require unrestricted access to a user's entire photo library to provide these features. Photographs submitted through the platform are processed for the purposes associated with the relevant feature and in accordance with this Privacy Policy.

2.7 Information We Do Not Intentionally Collect

NearoMarket's current applications do not require access to users' precise GPS location, device contact lists, SMS message contents stored on a user's device, or microphone recordings.

Authentication and verification messages may be delivered through authorised third-party service providers without requiring NearoMarket to access SMS messages stored on users' devices.

If future functionality requires additional categories of personal information or device permissions, NearoMarket will update its disclosures and obtain permissions or consent where required under applicable law.

2.8 Information Provided Through Support and Other Interactions

Users may voluntarily provide additional information when contacting NearoMarket through customer support, email, complaint-resolution processes, or other permitted communication channels. This may include contact details, order references, descriptions of issues, supporting documents, and information reasonably relevant to their requests.

NearoMarket may process this information for customer support, dispute resolution, security, compliance, and related legitimate operational purposes, subject to applicable law.

3. How We Use Personal Information

NearoMarket collects and processes personal information for specified purposes reasonably necessary to operate, administer, secure, maintain, and improve its platform and related services. Depending on the user's role, interactions and applicable legal requirements, personal information may be processed for the purposes below.

3.1 Account Registration, Authentication and Management

3.2 Marketplace Operations and Order Fulfilment

3.3 Payments, Fees and Financial Administration

NearoMarket facilitates direct payments between residents and independent vendors and does not ordinarily receive or hold underlying resident-to-vendor payments. We may process relevant information to:

Payment-confirmation photographs are supporting records and do not independently establish that the intended vendor received payment.

3.4 Service Communications and Customer Support

Communications may be delivered through the application, email, SMS, or other supported channels, where appropriate and permitted by law.

3.6 Platform Maintenance and Improvement

Where reasonably practicable, aggregated or de-identified information may be used for service analysis and improvement.

3.7 Limitations on Use

NearoMarket processes personal information for the purposes described in this Privacy Policy and for other purposes disclosed to users in accordance with applicable law.

Personal information will not be used for materially unrelated purposes without additional notice or consent where required under applicable law.

NearoMarket does not currently use third-party advertising networks within its applications and does not sell users' personal information to advertisers or other third parties.

Promotional banners and marketplace-related communications may be displayed within the platform to inform users about NearoMarket, participating vendors, available products, promotional offers and related services. Such promotional activities do not involve selling personal information to third-party advertisers.

Material changes in data-processing practices will be addressed through policy updates and additional notice or consent where required by law.

4. How Personal Information Is Shared

NearoMarket may disclose or make personal information available to authorised individuals, participating vendors, delivery partners and third-party service providers where reasonably necessary to provide services, fulfil orders, maintain operations, resolve disputes or comply with law. Access depends on the user's role, transaction and purpose.

4.1 Information Shared with Vendors

Vendors may receive order information including products, quantities, amounts, applicable fees, payment status and fulfilment details. The Vendor Partner application does not display residents' mobile numbers or residential delivery addresses to vendors.

Vendors may receive additional information where necessary to address a specific transaction or dispute, subject to applicable law and appropriate operational controls.

4.2 Information Shared with Delivery Partners

Authorised delivery partners may receive information reasonably necessary for assigned deliveries, including the resident's first name, delivery address and contact number, vendor pickup and contact details, and relevant order, payment and delivery information. The resident's first name and contact number are removed from the delivery partner's order screen once the delivery is completed or closed.

Where supported by the application, delivery partners may contact residents and vendors through designated calling functions during an active delivery. These calling functions are made available while the order is in progress and removed from the application interface upon successful delivery.

Delivery partners are expected to use this information solely for authorised delivery purposes and not misuse, disclose or retain it for unrelated purposes. NearoMarket implements access restrictions intended to limit availability according to assigned responsibilities, subject to applicable technical, operational and legal requirements.

4.3 Information Available to Residents

Residents may access vendor shop names, descriptions, photographs, products, prices, availability and payment details needed to complete their own orders. Vendor UPI IDs or QR codes may be displayed for direct payment. Delivery-related contact information may be provided where supported and reasonably necessary for an active order.

4.4 Access by NearoMarket Administrators

Authorised administrators may access information reasonably necessary for account administration, vendor and delivery partner approvals, order support, billing and commission calculations, payment reconciliation, complaints, disputes, security investigations and legal compliance.

Access to payment-confirmation photographs is restricted to authorised administrators and is not provided through the three mobile applications after submission. Administrative access is subject to applicable access controls and operational safeguards.

4.5 Third-Party Service Providers

NearoMarket may engage technology and infrastructure providers for hosting, storage, authentication, messaging, notifications, email communications, security and platform operations. Providers may process relevant information as appropriate to their services and applicable responsibilities. Further information is in Section 5.

NearoMarket may disclose relevant information where required or permitted by law, including for lawful requests, judicial or regulatory proceedings, legal claims, fraud investigations, protection of users and security incidents.

4.7 Limitations on Disclosure

NearoMarket does not sell users' personal information to advertisers or other third parties. Access is intended to be restricted to legitimate operational, contractual, security, compliance and other purposes described here. Materially different disclosures are subject to additional notice or consent where required by law.

5. Third-Party Service Providers and Data Processing

5.1 Engagement of Service Providers

NearoMarket engages selected third-party technology, infrastructure and communication service providers to support operation, maintenance, security and delivery of its services. Providers may process personal information to the extent reasonably necessary for their functions, subject to applicable service agreements, privacy practices, technical arrangements and legal requirements.

NearoMarket seeks to limit information provided to what is relevant and reasonably necessary. Engaging providers does not remove NearoMarket's responsibilities under applicable data-protection laws.

5.2 Categories of Service Providers

a. Authentication and Verification: NearoMarket uses MSG91 for mobile verification, OTP delivery and supported authentication functions. Relevant mobile numbers, verification requests and related technical data may be processed.

b. Application and Database Hosting: NearoMarket uses Render for application hosting, backend processing, database infrastructure and related operations. Information processed through the platform may be stored and handled there.

c. Cloud Storage and Content Delivery: NearoMarket uses Cloudflare, including R2, to store and manage vendor shop photos, product images, QR codes and payment-confirmation records. Payment-confirmation photographs are stored using restricted-access infrastructure.

d. Mobile Application and Notification Services: Where configured and applicable, NearoMarket may use Expo, Google Firebase Cloud Messaging and Apple Push Notification service. Such services may process device tokens, identifiers, notification content and relevant technical information.

e. Email and Customer Communications: NearoMarket may use third-party email and communication services for incoming and outgoing account messages, verification communications, vendor statements and support. Providers may process contact details and message content as necessary. The official support email is support@nearomarket.com.

f. Technical Operations and Security: Where enabled, NearoMarket may use an error-monitoring service (currently Sentry) to detect and diagnose application errors. Error reports are configured to exclude personal data such as names and contact details by default. Other supporting services may be used for monitoring, availability and security as appropriate to their configuration.

5.3 Information Processed by Service Providers

Depending on the service, providers may process relevant contact details, verification requests and events, account/order/delivery/transaction information, submitted images and documents, push tokens, and diagnostic, access or security information.

NearoMarket does not authorise providers to use personal information for unrelated purposes merely because they supply platform technology or infrastructure.

5.4 Data Hosting and International Processing

NearoMarket may use infrastructure or providers whose systems, personnel or supporting operations are located in India or other jurisdictions. Personal information may be stored, accessed, transferred or otherwise processed outside India where necessary and legally permitted. NearoMarket's application servers and database are currently hosted in Singapore.

NearoMarket will take measures required by applicable law concerning international processing or transfers, including applicable restrictions and safeguards. Provider headquarters do not necessarily indicate where all data is processed.

5.5 Security and Access Safeguards

NearoMarket seeks to apply reasonable technical, organisational and operational measures appropriate to the information and services involved. Depending on the infrastructure, these may include restricted administrative access, authentication and role-based controls, encrypted connections, service-specific credentials and permissions, and appropriate hosting and storage configurations.

Storage and Access to Payment-Confirmation Records: NearoMarket stores payment-confirmation photographs using restricted-access cloud storage infrastructure. They may contain residents' names, UPI IDs, amounts, transaction references and other visible details. They are not intended for public access and are made available only to authorised administrators for payment documentation, dispute resolution and related operational purposes. Underlying storage access is controlled through service-specific credentials and permissions. These records are subject to the retention and deletion practices in this policy.

No electronic system, transmission method or storage environment can be guaranteed to be entirely free from security risks.

5.6 Changes to Service Providers

NearoMarket may engage, replace or discontinue providers for operational, reliability, functionality, security, commercial or regulatory reasons. Where changes materially affect personal-data processing, NearoMarket will provide updates, notices or seek consent where required by law. Additional providers remain subject to applicable operational, security and legal requirements.

6. Data Retention and Deletion

6.1 General Retention Principles

NearoMarket retains personal information for as long as reasonably necessary to fulfil the purposes described in this policy, provide and administer services, maintain security, resolve disputes and comply with legal obligations.

Periods vary by information type, processing purpose, the user's relationship with the platform and applicable requirements. NearoMarket seeks to limit identifiable retention and takes appropriate steps to delete, anonymise or otherwise dispose of information when no longer required, subject to applicable law.

6.2 Account and Profile Information

Account information may be retained while reasonably necessary to provide and administer services. Following successful account deletion, NearoMarket will delete or anonymise applicable account and profile information, except where continued retention is required or permitted by law.

Deletion may be subject to resolving outstanding orders, payment obligations, delivery responsibilities, identity verification or other legitimate restrictions. Users who cannot complete automated deletion may request assistance at support@nearomarket.com. Details are available at https://nearomarket.com/delete-account.

6.3 Order and Delivery Records

Order and delivery records may be retained for transaction documentation, reconciliation, complaints, disputes, fraud prevention, security and legal compliance. These may include order details, amounts, fees, delivery statuses and timestamps.

Following account deletion, identifiers linked to historical transactions may be removed, minimised or anonymised where appropriate, while justified transaction records may remain. Identifiable retention is subject to relevant purposes, law and access restrictions.

6.4 Payment-Confirmation Photographs

NearoMarket ordinarily retains payment-confirmation photographs for up to 90 days from upload for payment documentation, transaction verification and dispute resolution.

After the applicable period, they are deleted through NearoMarket's retention and deletion processes, unless continued retention is required or permitted under applicable law for an identified obligation, investigation or dispute. Photographs may be deleted earlier following successful account deletion or when no longer necessary, subject to law.

Access remains restricted to authorised administrators in accordance with this policy.

6.5 Financial, Billing and Commercial Records

NearoMarket may retain information relating to orders, delivery charges, platform fees, commissions, vendor statements, reconciliation and commercial transactions for periods reasonably necessary to fulfil applicable accounting, taxation, regulatory and legal obligations.

Periods may vary with record type, statutory requirements and pending assessments, investigations, disputes or proceedings. Where reasonably practicable and legally appropriate, identifiers may be removed, anonymised or minimised while necessary financial records are preserved.

Where a vendor who deletes their account has billing records, the shop's business name and registered mobile number are kept in restricted administrative records, which are not shown in the apps, for as long as billing, reconciliation, tax, dispute or legal requirements justify. They are removed once that need ends.

Personal information will not be retained indefinitely solely for potential future business requirements; continued retention must have an identifiable lawful purpose.

6.6 Authentication and Security Information

Authentication credentials, OTP verification information, application logs, push tokens and security-related records may be processed and retained for appropriate operational, security and compliance periods.

Temporary verification credentials are intended to expire or become invalid after use or expiry. Other security records may be retained as reasonably necessary for protection, incident investigation, troubleshooting, fraud prevention and law.

Following successful account deletion, associated authentication credentials and active session access will be invalidated or removed in accordance with implemented procedures, subject to technical and legal requirements.

6.7 Support Requests and Account-Deletion Records

NearoMarket may retain relevant support communications, complaints, disputes, deletion requests and administrative records as reasonably necessary to address the matter, demonstrate compliance, prevent misuse or meet legal obligations. Such records may include request details, references, communications and actions taken. Identifiers may be removed, minimised or anonymised when no longer needed.

6.8 Deletion, Anonymisation and Retention Exceptions

When personal information is no longer reasonably necessary, or a valid deletion request is completed, NearoMarket will take appropriate deletion or anonymisation steps, subject to law and operational requirements.

Records may be retained where necessary or permitted under law for accounting or tax matters, regulatory compliance, fraud or security investigations, unresolved transactions or disputes, legal claims, lawful directions or proceedings. Retention is limited to information and duration justified by the relevant purpose.

Where technically applicable, deletion may cover operational databases, cloud storage and associated systems. Residual data in backups may remain temporarily until the applicable backup cycle expires, subject to safeguards and law. Retained information will not be used for purposes incompatible with the justification for keeping it.

7. Your Privacy Rights and Choices

NearoMarket respects users' privacy rights and provides means to raise requests and concerns. Rights and procedures are subject to applicable law, request type and verification requirements.

7.1 Access to Personal Information

Users may request information about personal data processed in connection with their accounts and platform activities, including categories, purposes and relevant disclosures to the extent required by law. NearoMarket may verify identity and authority before disclosing information.

7.2 Correction and Updating of Information

Users may request correction, completion or updating of inaccurate, incomplete or outdated information. Certain information may be changed in the apps; other changes may need verification, administrative review or supporting information. Requests may be declined or deferred where permitted by law to prevent unauthorised changes or preserve accurate transaction records.

7.3 Account Deletion and Erasure

Users may request account deletion through the relevant app or support@nearomarket.com. Deletion may be subject to resolving outstanding orders, payments, deliveries, verification or other applicable restrictions. After successful deletion, data is deleted or anonymised under applicable procedures, retention practices and law. See https://nearomarket.com/delete-account.

Where processing relies on consent, users may withdraw it through available means or by contacting NearoMarket, subject to law. Withdrawal may affect services dependent on that processing; it does not automatically invalidate earlier lawful processing or require deletion of lawfully retained records. Supported notification permissions and preferences may be managed in the app or device settings.

7.5 Complaints and Grievance Redressal

Privacy questions, requests and complaints may be sent to support@nearomarket.com. NearoMarket reviews and addresses them under applicable legal requirements, accounting for the request's nature and reasonable verification or investigation. Applicable statutory response periods will be followed.

7.6 Nomination and Authorised Representatives

Where provided by applicable law, a person may nominate someone to exercise relevant privacy rights in the event of death or incapacity. Nominees and representatives may be required to establish identity and authority and provide appropriate documentation.

7.7 Verification and Protection Against Unauthorised Requests

NearoMarket may seek reasonable verification for access, correction, disclosure or deletion requests, depending on sensitivity. Requests may be restricted, deferred or declined where required or permitted by law, including to protect others' privacy, security and legally protected interests.

7.8 Changes to Available Rights and Procedures

NearoMarket may update request procedures and account-management features in response to legal, functional or operational changes without limiting rights available under applicable law. Users can request further information at support@nearomarket.com.

8. Account Deletion

8.1 Account Deletion Requests

NearoMarket provides deletion functionality in its Resident, Vendor Partner and Delivery Partner applications. Eligible users may initiate deletion in the relevant app, subject to verification, eligibility and security requirements. Users unable to complete in-app deletion may contact support@nearomarket.com.

8.2 Verification and Outstanding Obligations

NearoMarket may require identity verification to prevent unauthorised deletion. Residents use OTP verification; vendors and delivery partners use password confirmation for the currently supported in-app deletion workflows. Other reasonable verification may apply to assisted requests.

Automated deletion may be temporarily unavailable where unresolved orders, financial obligations, delivery responsibilities or other matters require review. Support requests will be assessed under law, account obligations and deletion procedures.

8.3 Effect of Account Deletion

After successful deletion, NearoMarket takes appropriate steps to disable the account and delete or anonymise personal information under implemented procedures and law. Certain historical transaction, billing, compliance, security or dispute records may be lawfully retained, with identifiers minimised or anonymised where appropriate. Account deletion does not automatically remove records lawfully required or permitted to be retained.

8.4 Additional Information

See https://nearomarket.com/delete-account for detailed procedures, verification, restrictions and retention practices, or contact support@nearomarket.com.

9. Data Security

9.1 Our Approach to Information Security

NearoMarket seeks to implement reasonable technical, organisational and operational safeguards appropriate to the information, services and security risks involved. They are intended to reduce unauthorised access, disclosure, alteration, misuse, loss or destruction. Security practices may be reviewed and updated in response to risks, operations, technology and law.

9.2 Authentication and Account Protection

NearoMarket uses authentication and account-verification mechanisms designed to reduce unauthorised access to accounts and sensitive functions. Depending on application, role and operation, these may include mobile-number OTP verification, password authentication, secure credential handling, limits on repeated OTP requests and incorrect code entries, temporary pauses after repeated incorrect password attempts at sign-in and in sensitive operations such as account deletion or changing a registered mobile number, and account and session-management controls.

Specific measures vary by functionality and implemented controls and may be enhanced to address identified risks and applicable obligations.

9.3 Information Transmission and Storage

NearoMarket uses secure communication protocols, including HTTPS, for supported communications between production applications and backend services. Information is maintained within systems subject to applicable access controls and configurations. Payment-confirmation photographs use restricted-access cloud storage and are not intended for public access; storage permissions are designed to limit unauthorised access.

9.4 Access Controls and Administrative Security

Role-based access mechanisms are intended to restrict information to authorised responsibilities of residents, vendors, delivery partners and administrators. Payment photographs are restricted to authorised administrators for operational, security, compliance or dispute purposes. NearoMarket may maintain relevant access, security and operational records for administration, troubleshooting and suspected misuse investigations.

9.5 Security Incidents and Response

No electronic platform or transmission or storage method can be guaranteed completely secure. Where NearoMarket becomes aware of an actual or suspected security incident, it may investigate, assess impact and take appropriate steps to contain, address or mitigate risks. Where notice to individuals, regulators or authorities is required by law, NearoMarket will seek to meet applicable requirements and timelines.

9.6 User Responsibilities

Users are encouraged to safeguard passwords and OTPs, avoid sharing credentials, use supported app versions and device-security settings, and report suspected unauthorised access to support@nearomarket.com. These precautions do not limit NearoMarket's legal responsibilities.

9.7 Changes and Improvements to Security Measures

NearoMarket may modify security measures to address emerging risks, operational needs, technology and legal changes. Measures may differ by information type, infrastructure and functionality. Nothing here limits rights or remedies under law.

10. Children's Privacy

NearoMarket's services are intended for individuals aged 18 years or above. Individuals under 18 are not permitted to independently register for or operate accounts on the platform.

NearoMarket does not knowingly solicit personal information from children or intentionally provide account-based services to individuals under 18.

Users are responsible for providing accurate information regarding eligibility. NearoMarket may rely on information provided during registration and may implement additional verification where reasonably necessary or required by law.

If NearoMarket becomes aware that an account may be operated by an individual under 18, it may verify the circumstances, restrict access, suspend or close the account, and delete or otherwise handle related information in accordance with law.

Parents and guardians who believe a minor has registered or is using the platform may contact support@nearomarket.com. NearoMarket may request reasonable verification while minimising unnecessary additional personal information.

11. Changes to This Privacy Policy

11.1 Policy Updates

NearoMarket may review, amend or update this Privacy Policy to reflect changes in services, operations, infrastructure, security practices, data processing or applicable law. Updates may include clarifications, corrections, disclosures or new functionality.

11.2 Notification of Changes

The latest policy will be available on NearoMarket's website and, where applicable, apps. For material changes affecting data processing, NearoMarket will provide appropriate notice and seek additional consent where law requires. Notice may use in-app communications or other appropriate channels.

Minor editorial changes that do not materially affect privacy rights or practices may be made without separate acknowledgement unless law requires otherwise.

11.3 Effective Date and Version Control

Each published version will identify its effective date. NearoMarket may maintain previous versions and acknowledgement records as reasonably necessary for audit, compliance, operations or disputes. Where renewed acknowledgement or consent is required, NearoMarket may obtain and record it before the relevant processing.

11.4 Continued Use of Services

Users are encouraged to review this policy periodically. Continued use after an update does not itself replace legally required notice or consent. Questions may be directed to support@nearomarket.com.

12. Contact Information and Grievance Redressal

12.1 Contacting NearoMarket

Users may contact NearoMarket about this policy and the collection, use, disclosure, retention or security of personal information.
